29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Back and side of roof: On December 4, 2012 and at times prior thereto the controlling employer Todd Campbell Construction, Inc., did not ensure that the sub-contractor protected their employees while they performed sheathing activities on a 8 in 12 pitched roof without a fall protection system in place. Note) Abatement certification IS required for this item.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) Residential jobsite: On December 4, 2012 and at times prior thereto Todd Campbell Construction, Inc., did not ensure through frequent and regular inspections of the jobsite that the sub-contractor's, including but not limited to the framers, were providing for and enforcing appropriate safety measures for their employees. The framing sub-contractor performed sheathing activities without a fall protection system in place. Note) Abatement certification IS required for this item.
