29 CFR 1910.101(b):   The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:  NEAR PLASMA CUTTER and OVERHEAD DOOR:  On or about December 21, 2012 several compressed gas cylinders were not stored securely to prevent them from falling. 29 CFR 1910.1200(e)(1):   The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  On or about December 21, 2012 a written hazard communication program had not been developed to address employees exposure to hazardous chemicals including, but not limited to, compressed gases (e.g., oxygen, nitrogen, and argon) metal fumes generated during MIG and TIG welding (e.g., nickel, iron, chromium and zinc oxides), ozone, and nitrogen dioxide.

29 CFR 1910.1200(h):   Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced.  On or about December 21, 2012 training had not been provided for employees who were welding informing them of the hazards associated with combustible gases (oxygen, nitrogen, and argon), metal fumes generated during MIG and TIG welding (e.g., nickel, iron, chromium and zinc oxides), ozone, and nitrogen dioxide.

29 CFR 1910.134(c)(2)(i):   Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  At the time of the inspection on or about December 21, 2012, the employer made 3M N-95 Particulate Respirators available to employees at their discretion.  Training in accordance with Appendix D of this standard had not been provided.
