Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to rollover or impact hazards while pulling rail hopper cars with a tractor/payloader and a single tow rope attached to the rear of the payloader:     (a) On or about December 20, 2012, and at times prior, employees were exposed to a potential hazard of a rollover or impact hazards while pulling rail hopper cars with a tractor/payloader and the use of a single tow rope attached to the back of the payloader at the Equity Cooperative Elevator Company of Sheyenne, located at 203 Main Street North, Sheyenne, North Dakota.       Among other methods, one feasible and acceptable method to correct this hazard would be to move railcars by pushing rather than pulling or by the use of a secondary chain or tow rope connected to the front end of the tractor/payloader and to the railcar to secure the movement of the railcar.
