29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    The employer does not guard the rotating parts of machines whose operation exposes employees to injury.     a. This violation was observed on or about December 28, 2012, in the fabrication area where employees were exposed to caught-by hazards while working near an ACDC 1,000 Welder without a guard over the ingoing nip points of a WWRD-3S Weldwire brand part roller.      b. This violation was observed on or about December 28, 2012, in the fabrication area where an employee was exposed to caught-by hazards while welding a pipe being rotated by a WWRD-3 Weldwire brand part roller without a guard covering ingoing nip points.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all machines that expose employees to hazards are guarded.

29 CFR 1910.305(g)(2)(ii): Flexible cords were not used only in continuous lengths without splice or tap:    The employer does not ensure that all flexible cords are used in continuous lengths without being spliced or tapped to prevent employee injury. This violation was observed on or about December 28, 2012, in the fabrication area where an employee was exposed to an electrical hazard while working with an extension cord that was cut and fixed with tape.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure all flexible cords and cables are used in accordance with 29 CFR 1910.305(g).

This violation was identified on or about December 28, 2012, in the facility where an employee that was injured and placed on restricted duty on October, 17 2012, was not listed on the 2012 OSHA 300 Log.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all recordable injuries are recorded in accordance with 29 CFR 1904.

This violation was identified on or about December 28, 2012, in the facility where employees voluntarily used tight fitting 3m 6000 series respirators before a respiratory protection program was in place. 29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    The employer does not ensure that employees required to operate forklifts are trained and evaluated to ensure they can operate them safely. This violation occurred on or about December 28, 2012, and at times prior thereto, when employees in the facility were required to operate forklifts while moving material without having been trained and evaluated to ensure he could do so safely.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that they provide the employees training consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.
