29 CFR 1926.451(g)(1):  Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a)  Scaffolding located on East side of Tower at 303 De La Mare, Fairhope AL 36532:  On or about December 21, 2012 and at times prior thereto, the employer exposed an employee to a 33' fall hazard in that an employee was allowed to work from the top level of a five buck scaffold without fall protection such as but not limited to guardrail systems, personal fall arrest systems, or safety net systems.  The employee was painting the trim at the Tower eave while standing atop the scaffolding located at the east face of the Tower.    b)  Scaffolding located on South side of Tower at 303 De La Mare, Fairhope AL 36532:  On or about December 21, 2012 and at times prior thereto, the employer exposed an employee to a 33' fall hazard in that an employee was allowed to work from the top level of a five buck scaffold without fall protection such as but not limited to guardrail systems, personal fall arrest systems, or safety net systems.  The employee was painting the trim at the Tower eave while standing atop the scaffolding located at the south face of the Tower.
