29 CFR 1910.23(a)(2): Every ladder way floor opening or platform was not guarded by a standard railing with standard toe board on all exposed sides (except at entrance to opening), with the passage through the railing either provided with a swinging gate or so offset that a person cannot walk directly into the opening. a) On or about December 27, 2012, at the above located work place, employees were required to work on a platform (at tank T-65) that was approximately 15 feet above the ground. The platform had an unguarded ladder way entrance. The employees were thereby exposed to the hazards associated with falls.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) On or about January 29, 2013, at the above located workplace, employees were required to access and work atop of tankers trailers under a covered unloading area. These employees were exposed to fall hazards from a height of approximately 10 to 12 feet above ground level. Protective equipment, such as a body harness and lanyard, was not used by employees to protect them against injury in the event of a fall.

29 CFR 1910.134(h)(3)(iv)(B): For respirators maintained for emergency use, the employer did not certify the respirators by documenting the date inspections were performed, the name (or signature) of the person that performed the inspection, the findings, the required remedial action, and the serial number or other means to identify the inspected respirators; and provide the information on a tag or label attached to the storage compartment for the respirator, kept with the respirator, or included in inspection reports stored as paper or electronic files. a) On or about January 29, 2013, at the above located work place self-contained breathing apparatuses (SCBAs) were available for employees to use in case of an emergency. The SCBAs kept near tank T1 did not have an inspection tag or label attached to its storage compartment.

29 CFR 1910.1200(g)(2)(xii): Each Material safety data sheets (MSDS) for hazardous chemicals did not contain at least the name, address and telephone number of the chemical manufacturer, importer, employer or other responsible party preparing or distributing the material safety data sheet, who can provide additional information on the hazardous chemical and appropriate emergency procedures, if necessary: a) On or about December 27, 2012, at the above located workplace, the employer produced a chemical product called Tin Cake. The Tin Cake Material safety data sheet used by the company did not contain at least the name, address and telephone number of the chemical manufacturer, importer, employer or other responsible party preparing or distributing the material safety data sheet, who can provide additional information on the hazardous chemical and appropriate emergency procedures, if necessary.
