Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On December 27, 2012, employees were performing a leak test on a 500 barrel tank (serial number 20271) by pressurizing the tank with air and no pressure relief device was used to prevent overpressure of the tank.
