29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: The employer does not guard machines to protect the operator and employees from hazards of the machine. a) This violation was observed on or about October 18, 2012 in the machine shop where employees were exposed to caught-in and caught-between hazards while operating a Drilling Machine BTA-3, Monarch and Standard Lathes without chuck guards on rotating chucks. b) This violation was observed on or about October 18, 2012 in the honing department where employees were exposed to caught-in and caught-between hazards while operating a Barnes Drill Hone # 3 without guard on the sanding mechanisms. c) This violation was observed on or about October 18, 2012 in the honing department where employees were exposed to caught-in and caught-between hazards while operating a Lehman Hydradtrol Manual Lathe #1 and #2 without chuck guards. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all machines are guarded to protect the operator and other employees in the machine area from hazards.

29 CFR 1910.219(c)(2)(i): All exposed parts of horizontal shafting seven (7) feet or less from floor or working platform, excepting runways used exclusively for oiling, or running adjustments, shall be protected by a stationary casing enclosing shafting completely or by a trough enclosing sides and top or sides and bottom of shafting as location requires. The employer did not guard a horizontal rotating shaft of machine whose operation exposes employees to injury. This violation was observed on or about October 18, 2012, in the machine shop where employees were exposed to caught-in between hazards when operating the Long Gun Machine without the exposed shaft enclosed. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all horizontal shafts 7 feet or less from floor are guarded to protect the operator and other employees in the machine area from hazards.

The employer did not guard a rotating chain and sprocket of a machine whose operation exposes employees to injury. This violation was observed on or about October 18, 2012, in the machine shop where employees were exposed to caught-in hazards when operating the Long Gun Machine without the exposed sprocket wheel and chain enclosed. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all chain and sprockets which are 7 feet or less from floor are guarded to protect the operator and other employees in the machine area from hazards.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: The employer has not developed or implemented a written hazard communication program that describes how they will comply with this standard regarding labels and other forms of warning, material safety data sheets and employee information and training. This violation occurred on or about October 18, 1012, and at times prior thereto, when employees in the machine shop were required to handle hazardous chemicals before a written hazard communication program had been developed and implemented. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a written hazard communication program is developed, implemented, and maintained that includes the criteria specified in 29 1910.1200(f-h) .
