29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a.  On or about 1/4/2013, at the production area, Sherry Manufacturing Co., Inc., Miami, FL.  The employer had not developed and implemented a written hazard communication program for protecting employees from a chemical hazard presented by materials used (i.e. inks and adhesive used for screen printing) that they worked with on a daily basis.

29 CFR 1910.134(k)(6):  The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:    a. On or about 1/4/13, at the production department, Sherry Manufacturing Co., Inc., Miami, FL.  Employees were not provided with basic advisory information when disposable dust mask were offered for voluntary use during production operations, which can expose employees to chemical hazards.
