29 CFR 1910.178(l)(4)(ii): The employer did not ensure that refresher training, including an evaluation of the effectiveness of that training, was conducted as required by paragraph (i)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely in accordance with subparagraph [B]:    28800 Ida St., Valley, NE 68064 (Tool Crib): An employee was allowed to operate forklifts without their performance being evaluated following an accident where the employee was injured during a Yale forklift operation.     Abatement certification is required for this violation.  Abatement certification sheet is enclosed with the citation.

29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l), which includes the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:     28800 Ida St., Valley, NE 68064 (Tool Crib): The employer did not ensure that proper documentation of refresher forklift training and evaluation was developed and maintained, when such training and evaluation was required by paragraph (l):    a. The employees were assigned to drive a forklift that was different from the one they had been using previously in the summer of 2012, and refresher training and evaluation was required as per 29 CFR  1910.178(l)(4)(ii)(D).    b. Following an accident where an employee was injured during a Yale forklift operation, refresher training and evaluation was required as per 29 CFR 1910.178(l)(4)(ii)(B).     Abatement certification is required for this violation.  Abatement certification sheet is enclosed with the citation.
