29 CFR 1910.178(l)(1)(i):     The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).        a.  At the work site, employees operated fork lift trucks to unload incoming materials and load outgoing materials that were on pallets.  The employer did not provide employees with fork lift operator training and evaluation.

29 CFR 1910.178(p)(1):     If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.    a.  At the work site, employees used a Caterpillar fork lift truck which had a horn that did not sound.  The employer had not taken the truck out of service until the horn was repaired.

29 CFR 1910.1200(e)(1):     Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:    a.  At the work site, employees used propane-powered fork lift trucks to unload, move and load pallets.  The employer did not have  a  written hazard communication program for employees that included hazardous materials which included, but was not limited to, propane.

29 CFR 1910.1200(h)(1):     Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.    a.  At the work site, employees used propane-powered fork lift trucks to unload, move and load pallets of various materials that included, but was not limited to, propane tanks for the fork lift trucks.  The employer did not have a hazard communication training program for employees.
