29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) a) On or about December 12, 2012 the employer did not ensure that frequent and regular inspection of the jobsite was first made by a competent person before allowing employee to work in an area on a commercial flat roof section that had a recognized hazardous fall conditions through unprotected skylights located near column 27 - O. Employees started their work setting up tools and equipment in that area to begin work setting exhaust curbs located on column line R - 23 through 32 and a competent person did not first address fall hazards greater than 30 feet down through unprotected skylights .

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes. a) On or about December 12, 2012 located near column 27 - O employees worked in and egress to and from designated work zone areas on a commercial flat roof section that had unprotected skylights. The employees were not provided personal fall arrest systems, covers, or guardrail systems erected around such holes and were exposed falling 30 feet and greater through to the unprotected skylights.
