29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. a. On the jobsite where an employee was operating a forklift to move mortar and block/brick over uneven terrain, a seatbelt was removed from the forklift, thereby exposing the employee to a crushed-by hazard.

29 CFR 1926.300(b)(1): When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use. a. On the site where mortar was mixed to install block walls, the guards were removed from the top of the mixers and not replaced before using, thereby exposing employees to a caught-in hazard.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews. a. On the south side of the site where employees were walking on the scaffolds 11 feet 3 inches above the ground, a midrail guardrail was not installed, thereby exposing employees to a fall hazard.
