29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.     a)  John Smagola on or about January 10, 2013, at the address of 17801 N. Dixie Hwy. Bowling Green, OH: The employer failed to ensure employees were protected from falls while performing roofing work on a steep sloped commercial type structure. Employees working in this condition were exposed to falls of approximately 10 ft. to the ground below.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    a) John Smagola on or about January 10, 2013, at the address of 17801 N. Bowling Green, OH: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing various roofing operations.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step.    (a)  John Smagola on or about January 10, 2013, at the address of 17801 N. Dixie Hwy. Bowling Green, OH: The employer failed to ensure the top of an 8 ft. self-supporting ladder was not used as a step. An employee was utilizing the top of the ladder as a working surface to reach the roof level during shingling work. The employee was exposed to fall hazards due to improper ladder use.
