29 CFR 1917.13(f):     Loads requiring continuous manual guidance during handling were not guided by guide ropes (tag lines) that were long enough to control the load:    On or about 20 December, 2012 and at times prior thereto; at the Fagatogo Dock, net repair yard where loads requiring manual guidance during handling were not guided or controlled by guide ropes (tag lines) to keep the suspended fishing commercial nets away and the workers from underneath the loads.

29 CFR 1917.13(h):     The employer did not require employees to stay clear of the area beneath overhead drafts or descending lifting gear:    On or about December 20, 2012 and at times prior thereto; at the Fagatogo Dock, net repair yard where workers handling the commercial fishing nets were working directly underneath the loads, the crane boom and the lifting gear.

29 CFR 1917.50(a):     The employer used a material handling device listed in 29 CFR 1917.50(c) before ascertaining that the device had been certificated, as evidenced by current and valid documents attesting to compliance with the requirements in 29 CFR 1917.50(b):    On December 20, 2012; at the Fagatogo Dock, net repair yard, a material handling crane in use was not tested and inspected with certifications readily available for inspection.
