29 CFR 1926.150(c)(1)(vi):     A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas were being used on the jobsite:    (a)  On or about 01/11/13, at the new Wegmans Store under construction, located on 1750 East Avenue, in Rochester, New York,  a portable fire extinguisher was not provided within 50 feet, where at least 10 gallons of gasoline was in use and where ignition sources (6875 watt portable generator, and a mortar mixer) were in use.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(b)(1)(ii):     On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupers for personal protection.    (a)  On or about 01/11/13, at the new Wegmans Store under construction, located on 1750 East Avenue, in Rochester, New York,  a portable generator (Powermate 6875 watt) was in use in the mortar mixing area, in wet conditions, without GFCI protection.    NO ABATEMENT CERTIFICATION REQUIRED
