29 CFR 1910.23(d)(1)(ii): Stairway(s) less than 44 inches wide having one side open, did not have at least one stair railing on the open side: a) Between the 1st Floor and the Basement - The owner and employees were allowed use the wooden stairway which was missing a standard stair railing on the open side of the stair exposing them to a 6 foot fall hazard, on or about January 15, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.36(g)(2): Exit access(es) were not at least 28 inches (71.1 cm) wide at all points: a) Base Stairway Opening - The owner and employees were allowed use the stairs where the door opening is only 21 3/4 inches wide causing an egress problem and exposing them to a fire/smoke hazard, on or about January 15, 2013. No abatement certification or documentation required.

No materials or equipment may be placed, either permanently or temporarily, within the exit route: a) Second Floor Prep Room Area - A food prep worker was observed in the room where the fire exit was blocked by storage tubs and equipment exposing the worker to a fire/smoke inhalation hazard, on or about January 15, 2013. Abatement certification required within 10 days after abatement date.
