29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:       On or about February 26, 2013, at the above addressed jobsite:       a) An employee working as a polisher was exposed to continuous noise at 232% of the permissible 8-hour Time Weighted Average sound level of 90 dBA, or an equivalent sound level of 96 dBA during a 454-minute sampling period. Zero exposure was assumed for the un-sampled period of time (26 minutes).       b) An employee working as a fabricator was exposed to continuous noise at 233% of the permissible 8-hour Time Weighted Average sound level of 90 dBA, or an equivalent sound level of 96.1 dBA during a 454-minute sampling period. Zero exposure was assumed for the un-sampled period of time (26 minutes).         c) An employee working as a wood worker was exposed to continuous noise at 66% of the permissible 8-hour Time Weighted Average sound level of 90 dBA, or an equivalent sound level of 87.1 dBA during a 454-minute sampling period. Zero exposure was assumed for the un-sampled period of time (26 minutes).      The employer, Designers Tops, Inc. was previously cited for a violation of this occupational safety and health standard,  CFR 1910.95(c)(1), which was contained in OSHA Inspection 315358515, Citation 1, Item 1, and affirmed as a final order on 3/23/2012, with respect to a workplace located at 1350 NW 88th Avenue, Miami, Florida 33172.

On or about February 26, 2013, at the above addressed jobsite, a countertop fabricator was exposed to an 8-hour Time Weighted Average (TWA) of 1.1 mg/m3 of crystalline silica. The permissible exposure limit (PEL) was 0.511 mg/m3 for a sample containing 16% quartz. The employee was sampled for 429 minutes with zero dose assumed for the un-sampled period.      The employer, Designers Tops, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CR 1910.1000(c), which was contained in OSHA inspection number 315358515, citation number 1 Item 3a and was affirmed as a final order on 3/23/2012, with respect to a workplace located at 1350 NW 88th Avenue, Miami, Florida 33172.
