On or about January 23, 2013, the employer's Infection Control/Sterilization Guidelines policy did not contain:    1.  An exposure determination containing a list of all job classifications with their respective tasks and procedures in which occupational exposure to bloodborne pathogens may occur;  2.  A schedule and methods of implementation of engineering and work practices controls, personal protective equipment, and housekeeping;  3.  Hepatitis B vaccination and post-exposure evaluation and follow-up procedures;  4.  Communication of hazards to the employees;  5.  Recordkeeping of this standard; and  6.  A procedure for the evaluation of circumstances surrounding exposure incidents.

29 CFR 1910.1030(d)(4)(iii)(A)(1): Contaminated sharps were not discarded immediately or as soon as feasible in containers that were closable, puncture resistant, leak proof on side and bottom, and labeled or color-coded in accordance with paragraph (g)(1)(i) of this standard:    a. On or about January 23, 2013, at procedure rooms #7 and #8, the employer did not ensure that contaminated files used during root canal procedures were discarded immediately or as soon as feasible into the sharps containers.  Several contaminated root canal files were found laying around the sharps container lid and not inserted into the sharps container.

On or about January 23, 2013, at the laboratory, Assistants were required to use a mask while polishing and buffing orthodontic work such as crowns and bridges made out of Bitestone and Die-Keen for protection against the generated dust.  The employer had neither developed nor implemented a site-specific written respiratory protection program.
