Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that an employee was exposed to a fall hazard as a result of being lowered in the bucket:    (a)Sunshine Holdings at 1206 Main St., Fort Morgan, CO 80701:  On January 23, 2013, the employer did not ensure an employee was not utilizing the bucket of the Caterpillar 426C to lower an employee from the top of a conex box.  This condition exposed the employee to a fall hazard of up to approximately 7 feet.    Abatement Note:  Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow SAE J153, Surface Vehicle Recommended Practice, Section 4.3 Operator-General Precautions, instructs operators:  "Do not permit riders on the machine if there is no manufacturer's designated place for a rider."

29 CFR 1926.251(a)(1): Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it is safe and defective rigging equipment was not removed from service:      (a)Sunshine Holdings at 1206 Main St., Fort Morgan, CO 80701:  The employer did not inspect the rigging material prior to each use to ensure it complied with all the requirements of 29 CFR 1926.251(a) and (b).  The employer allowed the lift of a conex box utilizing a John Deere excavator and chains without ensuring the chains were physically capable of lifting the load without failure.
