29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    On or about January 29, 2013, the employer did not institute an effective hearing conservation program for employees exposed to noise levels in excess of the allowable 8-hour Time Weighted Average (TWA) sound level of 85 dBA.    a:  Noise sampling performed on wood worker, for 450 minutes indicated that the employee was exposed to a 63.4% noise dose which is equivalent to approximately 87.1 dBA.    b:  Noise sampling performed on aluminum cutter, for 453 minutes indicated that the employee was exposed to a 148.4% dose which is equivalent to approximately 93.3 dBA.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a hearing conservation program is created and implemented for all employees exposed to high levels of noise.  The program must include monitoring, audiometric testing, and training for affected employees.

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees required to use a tight fighting respirator are medically evaluated prior to respirator use.

The unused portion of the blade was unguarded, exposing employees to the hazard of being struck by the blade.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure machine guarding is in place to protect employees from accidental contact nip points, rotating parts, flying chips, saw blades, etc.
