OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    Zariana Wall Construction,  at the worksite located 2135 Wedgewood , El Paso TX 79928:  The employer did not prohibit employees from riding the bucket of the Allman hydraulic excavator to be used as a working surface while working on a rock wall exposing the employee to fall or struck by hazards from an inadvertent operation and movement, as observed on January 16, 2013.
