29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. (a) Facility - On or about January 25, 2013 the employer did not provide an energy control program or lockout program for an employee that was performing maintenance on a Bobcat 763 Skid Steer Loader.

29 CFR 1904.31(a): Basic requirement. You must record on the OSHA 300 Log the recordable injuries and illnesses of all employees on your payroll, whether they are labor, executive, hourly, salary, part-time, seasonal, or migrant workers. You also must record the recordable injuries and illnesses that occur to employees who are not on your payroll if you supervise these employees on a day-to-day basis. If your business is organized as a sole proprietorship or partnership, the owner or partners are not considered employees for recordkeeping purposes. Jobsite - On or about January 25, 2013 the facility had 3 workers compensation claims and these injuries/illnesses were not recorded on an OHSA 300 log. The dates that the employer was notified of the claims; November 15, 2011, October 15, 2012 and January 17, 2013.
