29 CFR 1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded: Or in the Alternative 29 CFR 1926.605(c)(2): The employer did not ensure that the deck or working surface of a barge was maintained in a safe condition. (a) Employees were exposed to serious injury from the unguarded pinch point between the sheave and the cable on the stern line running adjacent to the pump pit stairway on the Ross Island Dredge #7.

29 CFR 1926.1052(c)(4)(iv): Structural members in stairrail systems were not installed such that there were no openings in the stairrail system that were more than 19 inches (48 cm) wide: (a) Employees were exposed to serious injury from a stair railing that had a gap in the stairrail system greater than 19" between the lower end of the railing and the dredge pump pipe. The stairway was located in the pump pit near the forward center section of Ross Island Dredge #7.

29 CFR 1904.29(b)(3): Each recordable injury or illness was not recorded on the OSHA 300 Log and 301 Incident Report within seven calendar days of receiving information that a recordable injury or illness has occurred: (a) On or about January 28, 2013 the inspection revealed that an injury which occurred on September 24, 2012 was not recorded on the OSHA 300 Log and 301 incident report. The injury occurred within three miles of shore near Tokeland, Washington on an uninspected cutter section dredging barge.
