29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) Facility Wide - On or about January 15, 2013, an employee was injured while operating a fork lift truck. The employer did not ensure that each powered industrial truck operator, including temporary employees, were competent to operate powered industrial trucks safely as demonstrated by the successful completeion of training and evaluation on the powered industrial vehicles. In accordance with 29CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

There was no certification that included the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) who performed the training or evaluation. a) Facility Wide- On or about January 15, 2013, an employee was injured while operating a fork lift truck. The employer did not certify that each operator, including temporary employees, had been trained and evaluated on the operation of the powered industrial vehicles by maintaining records that included the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training. In accordance with 29CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.178(n)(11): The employer did not ensure that all dockboard(s) or bridgeplate(s) were properly secured before they were driven over: (a) Shipping Area (Dock #7) - On or about January, 15, 2013, an employee was injured while operating a powered industrial truck due to dock plate #7 having a brake band sytle hold down assembly that was worn that caused the dock plate to be raised. The powered industrial truck struck the unsecured, raised dock plate.
