29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a)Wal-Mart Stores East, LP, located in Lorain, Ohio. ON or about January 30, 2013 the employer did not ensure that employees were trained on how to operate the power lifting equipment exposing fellow employees to struck by, struck against, and caught between hazards in the backroom.

29 CFR 1910.304(g)(5): The path to ground from circuits, equipment, and enclosures was not permanent, continuous, and effective;    a)Wal-Mart Stores East, LP, located in Lorain, Ohio. On or about January 30, 2013 the employer did not ensure that the power cord used to charge the Yale Walkie Stacker and Yale Electric Pallet Jack was properly grounded. Employees charging the equipment in the backroom were exposed to contact with an electrical current hazard.
