29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.       a)  On January 29, 2013 and at times prior to, the employer did not ensure a body belt was worn and a lanyard was attached to the boom or basket when the employees were working from an aerial lift and exposed to fall hazards of up to 40 feet to the ground below.

29 CFR 1926.501(b)(13):  "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.      a)  On January 29, 2013 and at times prior to; the employer failed to ensure that employees painting windows at the edge of a balcony which is 40 feet above a lower level were protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.
