29 CFR 1926.95(a):     Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition, wherever it was necessary by reason of hazards of process or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:    On or about January 30, 2013, an employee was exposed to a struck by hazard while operating a JLG SkyTrak Telehandler, Model 10054, the employee was transporting a trash bin around the job site and not wearing the required seatbelt.

29 CFR 1926.602(d):     The employer did not certify that each operator had been trained and evaluated as required by 1910.178(l) of this chapter:    On or about January 30, 2013, an employee was observed operating a JLG SkyTrak Telehandler, Model 10054, the employer allowed the employee to operate the forklift prior to training and evaluation.
