29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident:  a. On or about February 4, 2013, the employer failed to inform OSHA within 8 hours of the death of one of the employees from a work related incident. The employer was advised of the victims death at approximately 17:30 pm on February 4, 2013 and OSHA was notified by the media at 08:20 am on February 5, 2013.
