OSH ACT of 1970 Section (5)(a)(1):      The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to struck-by and crushing hazards.        On or about 02/07/2013, at 523 Woodland Ave., Haddonfield, NJ, employees  of Hyperion Tree Service  were conducting the removal of a large tree adjacent to a home.  Workers were attempting to remove a nearly 19 foot section of the tree, overloaded the 1990 National Model 1295 17.5 ton mobile crane and caused same to overturn.      a)  A job briefing performed by the qualified arborist in charge was not conducted with all affected workers prior to the start of the job.      b)  A green log weight chart was not available to workers to assist in the calculation of the weight of the tree sections.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUMBIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
