29 CFR 1926.20(b)(2):     Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On or about February 7, 2013 at 3309 Office Park Drive, Kettering, a two story brick building under renovation, frequent and regular inspections were not conducted of the jobsite by a competent person to identify and address the fall hazards while performing prep work and bricklaying operations while on the low slope roof.

29 CFR 1926.451(g)(1):     Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.    On or about February 7, 2013, at 3309 Office Park Drive, Kettering, a two story brick building under renovation, mason employees were using a welded frame scaffold, (three bucks high) to hand concrete block up to the roof, approximately 20 ft. and an employee was standing on the cantilever without fall protection on the ends and exposed to a 15 ft. fall hazard.

29 CFR 1926.501(b)(1):     "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    On or about February 7, 2013, at 3309 Office Park Drive, Kettering, a two story brick building under renovation, two masons were standing near the edge of the low slope roof and exposed to a 20 ft. fall hazard without the use of fall protection.

29 CFR 1926.502(a)(2):     Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.    On or about February 7, 2013, at 3309 Office Park Drive, Kettering, a two story brick building under renovation, mason employees performing prep work before bricklaying around the open elevator shaft did not ensure that the appropriate fall protection was installed around the open elevator shaft before bricklaying operations.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    On or about February 7, 2013, at 3309 Office Park Drive, Kettering, a two story brick building under renovation, mason employees had not received training on the fall hazards while working on the low slope roof performing prep work prior to bricklaying around the elevator shaft opening.
