OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to impalement hazards.    a)  On or about February 5, 2013 and times prior at 345 Stone Park Boulevard, Pike Road, Al., Bldgs. 8-11 roof: The employer failed to ensure employees were protected  from impalement hazards by removing protruding nails from the 2x4's installed on the roof.  The 2X4's were used to hold shingle bags from sliding down the roof.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    a)  On or about February 5, 2013 and times prior at 345 Stone Park Boulevard, Pike Road, Al., Bldgs. 8-11: The employer failed to ensure employees using a Hitachi NV 45AB2, 1 3/4 inch pneumatic coil nailer guns in a contact trigger mode wore safety glasses which exposed them to eye injuries.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a)  On or about February 5, 2013 and times prior at 345 Stone Park Boulevard, Pike Road, Al., Bldgs. 8-11: The employer failed to ensure the extension ladder used to access the roof extended 3 feet above the landing which exposed employees to the hazards associated with falls of up to 9 feet 2 inches to the ground below.
