Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees in that employees were exposed to struck-by hazards in that: a) Inside the production portion of the facility, on February 7, 2013, the hoist attached to the top half of the vulcanizing press did not have a legible capacity rating. b) Inside the production portion of the faclity, on February 7, 2013, the hook latch for the hoist attached to the top half of the vulcanizaing press was not completely closed while under load.
