29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:    (a) At the site located at 12970 Westheimer Road, in Houston, Texas, on or about 02/08/2013 - Daily inspections were not made by a competent person.  The designated comepetent person was not competent in that he was unable to identify and correct hazardous conditions exposing employees to engulfment hazards when inadequate systems were used to prevent the occurrence of an excavation collapse.
