29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.     a)  Todd Marion Roofing on or about February 13, 2013, at the address of 7285 W. Harbor St. Port Clinton, OH: The employer failed to ensure employees were protected from falls while performing roofing work on a low sloped commercial type structure. Employees working in this condition were exposed to falls of approximately 9 ft. to the ground below.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    a) Todd Marion Roofing on or about February 13, 2013, at the address of 7285 W. Harbor St. Port Clinton, OH: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing various roofing operations.

29 CFR 1926.1053 (b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.     a)  Todd Marion Roofing on or about February 13, 2013, at the address of 7285 W. Harbor St. Port Clinton, OH: The employer did not ensure the side rails of the fiberglass extension ladder were extended at least three feet above the landing. Employees were exposed to falls while using the ladder to access the working level to perform roofing activities.
