Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) On or about 2/15/13 - Warehouse, employees were lifting other employees up on the forks and/or pallets, or were positioning a pallet onto the forks and climbing the sides of the forklift to retrieve merchandise while standing on the pallet.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) On or about 2/15/2013 - Warehouse, employees hired as warehouse workers and whose responsibilities include the operation of the forklift did not initially receive complete forklift training, up to and including formal instruction, practical and/or evaluation training on either the specific model of forklift or the immediate warehouse layout in where they were working.
