29 CFR 1910.119(d)(3)(ii):     The employer did not document that equipment complies with recognized and generally accepted good engineering practices.    Work site located at 9425 N. 48th Street, Omaha, NE; Rooftop of the facility, Production Refrigeration System at the Hot Room:  The ammonia relief system header discharge piping is located 93 above the roof surface. ASHRAE 15-2004, Section 9.7.8 states that pressure relief discharges are to be directed 15 feet above the ground, 20 feet from a window, ventilation or building entry.  In this instance, due to the fact that maintenance personnel work on the roof that is considered the working surface and the relief discharge should be 15 feet above the roof.  Employees of LoTemp Equipment Inc. perform weekly inspections of the area and are exposed to this hazard during those rounds.        Abatement certification is required for this violation. The abatement certification sheet is enclosed for the citations.

29 CFR 1910.119(h)(3)(i):   The contract employer failed to assure that each contract employee is trained in the work practices necessary to safely perform his/her job.       Worksite located at 9425 N. 48th Street, Omaha, NE:  The employer failed to ensure that as a contractor at a worksite that is required to meet the requirements of  29 CFR 1910.119, that each employee was trained in the work practices necessary to safely perform his/her job.  This is based upon the fact that LoTemp Equipment is contracted to perform a majority of the day to day maintenance activities and that site does not have the required Mechanical Integrity procedures for maintaining the anhydrous ammonia refrigeration system.  Although the employees of LoTemp have been trained on the maintenance of ammonia refrigeration systems in general, that training could not be specific to this site as there are not any developed site specific mechanical integrity procedures.         Abatement certification is required for this violation. The abatement certification sheet is enclosed for the citations.
