OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees (General Duty Clause): a) On February 27, 2013, and times prior thereto, in and around Warehouse 1 at the Worldwide ISCS, Inc. worksite in Garden City, GA, the employer failed to ensure that a Taylor 250 40K lb. forklift used daily was equipped with a seatbelt, exposing employees to struck-by and entrapment hazards following a tipover or collision. As a reasonable means of abatement, in accordance with ANSI B56.1-1993, the employer could have complied with this national consensus safety standard for low-lift and high-lift trucks manufactured after 1992 that must have a restraint device, system, or enclosure that is intended to assist the operator in reducing the risk of entrapment of the operators head and/or torso between the truck and the ground in the event of a tipover. ABATEMENT CERTIFICATION IS NOT REQUIRED.
