29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Jobsite: On or about February 22, 2013, two employees were not protected from falling from the roof of a house that was under construction. The two employees were installing tar paper on the roof. The pitch of the roof was 9 in 12 and the fall hazard to the two employees was approximately 20 feet to the ground.

29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: Note: Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsolete; or (3) Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employees has not retained the requisite understanding or skill: (a) Jobsite: On or about February 22, 2013, two employees needed to retrained in the use of fall protection. The two employees were working from a roof of a house that was under construction and there was no fall protection on the site. The fall hazard to the employees was approximately 20 feet and the pitch of the roof was 9 in 12.
