29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.   a) Avalon Dock Door #7: On or about 02/22/2013, at height greater than four (4) feet, employees disposing of refuse materials in the outdoor trash compactor were exposed to an open-sided platform that was not guarded by railings along all open sides.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.178(g)(2):   Battery charging apparatus for industrial trucks located in battery changing and charging installation was not protected from damage by trucks:   a) Warehouse Area near Panel Box B: On or about 02/22/2013, the charging cords on the Enforcer HF 163549 (M#: EH3-24-1000; S#: JF83771; 480 V, 13 Amps AC) and the Northeast Industrial Battery (M#: 3NE18-750; S#: 1219E4) industrial battery chargers  were damaged by forklift traffic exposing the employees to potential injury.

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:    a) Warehouse Area- Panel Box B: On or about 02/22/2013, non-approved circuit breakers were used daily to operate the overhead lights and forklift truck battery chargers.   b) Warehouse Area-Panel Box #2: On or about 02/22/2013, non-approved circuit breakers were used daily to operate the overhead lights and forklift truck battery chargers.   c) Warehouse Area-Panel Box #5: On or about 02/22/2013, non-approved circuit breakers were used daily to operate the overhead lights, an outdoor trash compactor and forklift truck battery chargers.   d) Warehouse Area-Panel Box#4: On or about 02/22/2013, non-approved circuit breakers were used daily to operate the overhead lights, overhead heaters, forklift truck battery chargers and dock door motors for dock doors #5 & #6.   e) Warehouse Area- Staging Department: On or about 02/22/2013, non-approved circuit breakers were used daily to operate the overhead lights and forklift truck battery chargers.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
