29 CFR 1904.39(a):     The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident:      On or about February 15, 2013, the employer failed to report an employee fatality.   On January 28, 2013, an employee sustained an injury at the worksite located at 911 Spencerville Ave., Delphos, Ohio, that injury resulted in the death of the employee on February 15, 2013.  The employer did not report the employee fatality within 8 hours after the death.
