29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    A. Jeff Shephard Construction LLC worksite located at 1093 Springcrest Dr., Waterville, Ohio: On or about February 26, 2013, the employer did not ensure employees were protected from head injuries while working below employees installing wood rafters. Due to this condition, employees were potentially exposed to impact injuries caused from falling material and/or equipment.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    A. Jeff Shephard Construction LLC worksite located at 1093 Springcrest Dr., Waterville, Ohio: On or about February 26, 2013, the employer did not ensure employees wore proper eye protection while operating pneumatic nail guns to install rafters on the two story residential structure. The employees were exposed to potential flying object hazards while operating the pneumatic fasteners.    Jeff Shephard Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.95(a), which was contained in OSHA inspection number 313782906, citation number 1, item number 1 and was affirmed as a final order on June 24, 2010, with respect to a workplace located at Toledo, Ohio.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:    A. Jeff Shephard Construction LLC worksite located at 1093 Springcrest Dr., Waterville, Ohio: On or about February 26, 2013,the employer did not ensure employees were protected from falls while installing rafters on the second story of a two story residential structure.  The employees were exposed to a potential fall distance of approximately 19.00 feet to the lowest level.    Jeff Shephard Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1) which was contained in OSHA inspection number 313782906, citation number 1, item number 2 and was affirmed as a final order on June 24, 2010, with respect to a workplace located at Toledo, Ohio.
