29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    (a) At the Del Webb - Richmond subdivision, located in Richmond, Texas, on or about 02/26/2013 - Employees were exposed to engulfment hazards while installing a new drainage system in an excavation approximately 35' x 23' x 9' that was not supplied with a means of access or egress.     HURTADO CONSTRUCTION COMPANY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1926.651(c)(2), WHICH WAS CONTAINED IN OSHA INSPECTION 480201, CITATION 1, ITEM 2 AND WAS AFFIRMED AS FINAL ORDER ON 10/29/2012, WITH RESPECT TO A WORKPLACE IN THE ALIANA SUBDIVISION, SECTION 8, RICHMOND, TEXAS 77406.    HURTADO CONSTRUCTION COMPANY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1926.651(c)(2), WHICH WAS CONTAINED IN OSHA INSPECTION 312924467, CITATION 2, ITEM 1 AND WAS AFFIRMED AS FINAL ORDER ON 09/12/2011, WITH RESPECT TO A WORKPLACE AT DEL WEBB RICHMOND SUBDIVISION IN RICHMOND, TEXAS.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that that:    (a) In the excavation, located north-northeast of Del Webb Blvd., on or about 02/26/2013 - Employees were exposed to engulfment hazards while working in a section of an excavation, approximately 15' x 23' x 9'      HURTADO CONSTRUCTION COMPANY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1926.651(c)(2), WHICH WAS CONTAINED IN OSHA INSPECTION 480201, CITATION 1, ITEM 3 AND WAS AFFIRMED AS FINAL ORDER ON 10/29/2012, WITH RESPECT TO A WORKPLACE IN THE ALIANA SUBDIVISION, SECTION 8, RICHMOND, TEXAS 77406. 29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:     (a) At the excavation site located North-Northwest of Del Webb Blvd., in Richmond, Texas, on or about 02/26/2013 -The designated competent person on-site was not competent in that he was unable to recognize hazardous conditions such as, but not limited to, the engulfment hazards presented by not having a means of egress in the excavation at all times and the engulfment hazards presented by benching Type B soil at a 2:1 ratio instead of benching the soil at a 1:1 ratio.
