29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On or about January 30, 2013; front of residential home; employees were observed working near and/or under the ladder jack scaffold or roof area without any head protection that would protect them from fall debris, materials or tools used in the process.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.452(k)(1): Ladder jack scaffold platforms exceeded a height of 20 feet (6.1 m):  a) On or about January 30, 2013; roof of residential home, employees were observed working off or walking on a ladder jack scaffold platform that that was 25 feet from ground level while replacing slate shingles on a 10 in 12 pitch residential roof.   For the purposes of this inspection, the employer was determined to be the controlling employer of the jobsite. The employer is being cited under OSHA's Multi-Employer Workplace Policy.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) On or about January 30, 2013; roof of residential home, employees were observed replacing slate shingles on a 10 in 12 pitch residential roof in which climbing belts were used in place of full body harnesses to prevent them from falling 30-35 feet to ground level.   For the purposes of this inspection, the employer was determined to be the controlling employer of the jobsite. The employer is being cited under OSHA's Multi-Employer Workplace Policy.

29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder:   a) On or about January 30, 2013; roof of residential home, an unsecured portable ladder was used to access the ladder jack scaffold platform used to performing roofing activities. It was observed that the portable ladder was not secured, nor was there any physical barrier to prevent contact with the base of the ladder. The area around the base of the ladder was used as a staging area.   For the purposes of this inspection, the employer was determined to be the controlling employer of the jobsite. The employer is being cited under OSHA's Multi-Employer Workplace Policy.
