OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries due to contact with a falling tree:   (a) On March 1, 2013, an employee sustained injuries when the tree he was tied off to fell. The injured employee climbed up a tree, after a conventional 45 degree cut was made, to cut branches off that were 30 feet high to prevent the tree from falling onto a house. While doing so the employee noticed the wind increased and the tree fell.   The employer did not consider all relevant factors pertaining to the tree and site area and did not develop plans before commencing work.  In addition the employer did not supply employees with the appropriate devices such as, but not limited to, blocks and wedges to use when the danger of a tree falling in the wrong direction and/or towards property presented itself.
