OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by suspended loads of roof trusses.  a.   On or about March 1, 2013, on the west side of the job site, the JLG G9-43A telehandler was used to suspend loads of roof trusses from the forks by a steel choker cable, exposing employees walking beside the load while handling tending lines to the hazard of being struck by the loads, a method not authorized by the manufacturer as stated in JGL Industries, Inc. letter of September 4, 2013 alerting the hazards of mast carriage damage and loss of load from rigging slipping off the forks.
