29 CFR 1926.95(a):     Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.    a. Intersection of Wolf Branch Road and Buck Fork Road:  The operator of the Case 580 Super K 4x4 rubber tired backhoe (Serial # JJGO165942) was not utilizing the seatbelt while operating the backhoe as observed on 2-20-13.    b. Intersection of Wolf Branch Road and Buck Fork Road:  The operator of the Kobelco 135SR LC (Serial # YH0404460) Excavator was not utilizing the seatbelt while operating the excavator as observed on 2-20-13.    c. Intersection of Turkey Camp Road and Buck Fork Road:  The operator of the Case 580L 4x4 rubber tired backhoe (Serial # JJG0230684) was not utilizing the seatbelt while operating the backhoe as observed on 2-20-13. Tiger Fork Road: Kobelco 135SR LC excavator with vibratory plate attachment (Serial # YH03-02194) was being operated without an operable backup alarm as observed on 2-20-13.    CHOJNACKI CONSTRUCTION COMPANY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.602(a)(9)(ii) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311683254, CITATION NUMBER 1, ITEM NUMBER 4, ISSUED ON 04-08-2010. THIS ITEM BECAME FINAL ORDER ON 4-25-2010, AND ABATEMENT WAS CERTIFIED ON 4-25-2010 WITH RESPECT TO A WORKPLACE LOCATED AT COUNTY ROUTE 12 PRINTER ROAD SETH, WV 25181.
