29 CFR 1910.23(a)(2):     Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening:    On or about 6 March 2013, and at times prior thereto, employees accessed the mezzanine level to retrieve packing materials or other stored items at a height of approximately 12 feet, where the fixed ladderway was open and unguarded, exposing the employees to a fall hazard to the concrete floor below.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure fall protection systems are in place at fixed ladderway openings.

29 CFR 1910.212(a)(1):     One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.    On or about 6 March 2013, and at times prior thereto, employees who work within the Kitchen area walk directly past a moving slat conveyor belt system which was unguarded, exposing the employees to the hazard of being caught in moving parts and nip points.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure moving parts on a conveyor system are guarded.

29 CFR 1910.305(j)(1)(i):     Fixtures, lampholders, lamps, rosettes, and receptacles located had live parts normally exposed to employee contact:    On or about 6 March 2013, and at times prior thereto, employees utilized energized 120 volt outlet receptacles that were not dead-front with the internal wires and terminals visible, exposing the employees to electrical hazards.  1) The energized 120-volt outlet receptacle located adjacent to the main office color copier/printer was not dead-front and the terminals tested as being energized at the time of the inspection. Cords for the copier/printer and the shredder were plugged into the outlet at the time of the inspection.  2) The energized 120-volt outlet receptacle located within the UPS shipping room was not dead-front and the terminals tested as being energized at the time of the inspection. Cords for an electronic scale and relocatable power tap were plugged into the outlet at the time of the inspection.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure all outlet receptacles are dead-front and have no exposed energized parts.

29 CFR 1904.32(b)(6):     At the end of each calendar year, the employer did not post the OSHA 300A Summary by February 1st and/or keep it posted for three months, until April 30th, as required by 1904.32(a)(4).    At the inspection site, for calendar year 2012, the OSHA Form 300A Summary of Work-Related Injuries and Illnesses was not signed, certified, or posted by February 1st as required by 1904.32(a)(4). As of the inspection date of 6 March 2013, the Summary was not posted in the workplace.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the Annual Summary (OSHA Form 300A) is completed, certified, and posted within the workplace from 1 February to 30 April of the following calendar year.
