29 CFR 1926.95(d)(1): The employer did not provide personal protective equipment, at no cost, to the employees. On or about March 5, 2013, and at times prior thereto, employees performing construction activities on a commercial appartment complex were not provided personal protective such as but not limited to fall protection, hard hats and eye protection by the employer. Employees were exposed to fall hazards and struck by hazards.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated On or about March 5, 2013 and at times prior thereto, employees installing Tyvek water resistive barrier using a JLG 660S and a JLG 800S aerial lift were not wearing personal fall protection and were exposed to the hazard of falling approximately 35 feet to the ground below.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system: On or about March 5, 2013, employees performing window installations in wall openings on the second, third and fourth story of a building were not protected from falling by guard rails or personal fall protection systems.
