This violation was observed on or about March 6, 2013, on the north side of the townhome where an employee was exposed to a fall hazard of approximately 20 feet, 6 inches when installing gutters on a residential townhome without a fall protection system.    Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee engaged in residential construction activities 6 feet or more above lower levels are protected by guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:      The employer does not ensure that when a portable ladder is used for access to an upper landing surface, the ladder side rails extend at least 3 feet above the upper landing surface to which the ladder is used to gain access.  This violation was observed on or about March 6, 2013, on the north side of the townhome where an employee was exposed to a fall hazard of approximately 20 feet, 6 inches when using an extension ladder to access a roof to install gutters without extending the ladder 3 feet beyond the landing of the roof.      Pursuant to 29 C.F.
